General terms and conditions of Domglas Naumburg

For all services offered here to consumers (§ 13 BGB), these General Terms and Conditions (GTC) apply.

The purchase contract is concluded when We accept your order by sending an order confirmation by e-mail.

The delivery time is usually 2 -4 days.  Goods shipments can also take up to 6 days.

Payment is made in advance by bank transfer or cash on collection. 

Until full payment, the goods remain our property. 

Exact information about quantities and payment will be sent to the customer with the order confirmation by e-mail. 

The prices are final prices, plus shipping costs.

     
1 - Provider, inclusion of the GTC

(1) Supplier and contracting party for DOMGLAS Naumburg presented goods is

(2) These general terms and conditions are part of every contractual agreement between the supplier (DOMGLAS NAUMBURG) and the respective customer.

Conflicting general terms and conditions of the customer are contradicted.

 
2 - Offer of goods and conclusion of contract

(1) The provider offers the displayed items to others here for sale.   The color representation of the articles may vary on the Internet pages.  Deviations are sometimes unavoidable. 

(2) Selection of goods, conclusion of contract and contract execution is in German. 

(3) The supplier delivers in the EU.

(4) The buyer selects the desired goods by ordering in contact, specifying article, name and color. Thus YOU as a buyer make a binding purchase request.

(5) The supplier confirms the conclusion of the contract with contract confirmation by e-mail. 

(6) In the event of delivery obstacles or other circumstances that could prevent the fulfillment of the contract, the provider will inform the buyer by e-mail. 

 
3 - Prices and payment

(1) All product prices are the final price plus shipping costs. The statutory sales tax is included. 

(2) The additional shipping costs will be communicated by the provider with the order confirmation.

(3) Deliveries to some countries may be subject to customs duties and import sales tax, which must be paid by the customer to the customs authorities upon receipt of the shipment. These duties would be additional costs to the purchase price and shipping costs. These are not to be influenced by the supplier. 

(4) The Provider delivers at the option of the Customer against advance payment by bank transfer or against cash payment upon collection. With the contract confirmation, the customer receives the necessary data by e-mail.

If the customer has chosen "cash payment" as payment method, he can pick up the goods here in Naumburg. 

(5) For advance payment orders, a payment period of one week from receipt of the contract confirmation applies. The supplier puts the desired goods back for the duration of the payment period for the customer. It is the responsibility of the customer to make his payment in time so that it is received by the provider within the deadline. 

The supplier reserves the right to withdraw from the contract of sale and to sell the goods elsewhere if the payment has not been received by the end of the period.

A payment received after withdrawal will be refunded to the purchaser or comparable offered.

 
4 - Shipping & delivery times

(1) The Supplier shall deliver the goods only after receipt of payment. 

(2) For products that are specially made for the customer, the delivery time increases accordingly if the customer requests individualisation and orders it in text form. 

(3) For shipments to destinations outside Germany, the corresponding delivery time shall be increased by the delivery company.

(4) Several products ordered at the same time shall be delivered in a joint consignment; the delivery time of the product with the longest delivery time shall apply to the joint consignment. If the orderer wishes delivery of a specific product with a shorter delivery time in advance, he must order this product separately. 

(5) If the delivery to the orderer fails because the orderer has given the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the orderer bears the direct costs of the new shipment. These costs correspond to the shipping costs agreed upon conclusion of the contract. 

(6) If the customer has chosen cash payment as the method of payment, the goods will not be dispatched. The customer can collect the goods or have them collected in Naumburg/s after the expiry of 9 working days after conclusion of the contract For individualised products (see paragraph 2), the time until provision is extended by one week. 

 
5 - Consumer - Right of revocation

(1) A purchaser who buys as a consumer shall be entitled to a right of withdrawal in accordance with the statutory conditions. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. 

(2) A consumer with permanent residence outside Germany shall be granted a 14-day cancellation period by the supplier even if the consumer's national law provides for a shorter period. 

(3) The supplier grants a consumer with permanent residence outside Germany the right to send the withdrawal declaration informally even if the consumer's national law provides for a stricter form. 

(4) For consumers with permanent residence in Switzerland, the requirements and legal consequences of the German consumer right of withdrawal shall apply even if Swiss law does not provide for withdrawal. 

 
6 - Warranty 

(1) For the glass goods offered here, the parties agree on a shortened limitation period of one year for warranty claims. However, the shortened limitation period shall not apply to claims based on injury to life, limb or health, nor to claims for other damages based on a grossly negligent or intentional breach of duty by the supplier, its legal representatives or its vicarious agents. 

(2) Otherwise, warranty claims shall be governed by the statutory provisions.

 
7 - Data protection information

(1) The supplier shall process the data referred to in paragraph 1 electronically for the proper performance of the contract, in particular for dispatch, invoicing and the booking of payments. For the purpose of shipping, the provider may also transmit the name and address of the customer to the commissioned shipping company. 

(2) The supplier shall store the data until all mutual claims arising from the order have been settled in full and the supplier's obligations under commercial and tax law to retain the data have expired. 

(4) The customer can demand information from the supplier at any time about the data that the supplier has stored about the customer. Furthermore, the customer may demand the correction of incorrect data at any time. 

(5) The responsible body for data protection is the provider named in § 1 paragraph 1. 

 
8 - Final provisions

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. However, German law shall not apply to consumers with permanent residence abroad insofar as the consumer's national law contains provisions from which the consumer cannot deviate by contract. 

(2) Should individual provisions of these general terms and conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

 

Cancellation policy and your right of cancellation

 

You have the right to cancel this contract in writing within 14 days without giving any reason. The revocation period is 14 days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

In order to exercise your right of withdrawal, you must inform DOMGLAS Naumburg in 06618 Naumburg/ S, Spechsart 38a by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation

 

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days of the day on which we received notification of your withdrawal from this contract.

For the repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without delay and in any case no later than 14 days from the day on which you notify us of the cancellation of this contract. 

The deadline is met if you send the goods before the end of the 14-day period.

 

You shall bear the direct costs of returning the goods.

Exceptions to the right of withdrawalYou only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

Exceptions to the right of revocation

​

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
